I understand and acknowledge that I am participating in Mini Mermaid Running Club (Mini Mermaid Running Club or Young Tritons Running Club, also known as “MMRC”), an athletic development program for girls and boys (the “Program”), as well as Run Sweat Love Family Fun 5k/1k Festival (“Race”), and that I am in good health and physical condition to engage in running and other strenuous physical activities. I further understand and acknowledge that engaging in running events, running races and related activities poses risks, including the risk of serious injury or death. I hereby release, waive and hold harmless MMRC, its officials, directors, employees, sponsors, agents, contractors, volunteers, and the Santa Cruz County Fairgrounds, its employees, sponsors, agents, contractors, volunteers (collectively, the “Released Parties”) from any and all liability or responsibility for injuries and/or property damage which I may sustain during the Program, Race and/or any related events or during my travel to or from the Program or Race events. This waiver and release covers myself (including all heirs, executors, or administrators) and is given in consideration of the Released Parties acceptance of registration/entry into the Program/Race. In addition, I agree to defend and indemnify the Released Parties, from any claim or action filed by a third party due to my actions in this Program/Race. In the event that I am unable to make decisions regarding my health and the contact listed cannot be reached in an emergency, I hereby give permission to the staff or volunteers of the Released Parties to secure proper treatment for myself. I do hereby consent to whatever x-ray, examination, anesthetic, medical, surgical or dental diagnosis or treatment and hospital care considered necessary in the best judgment of the attending physician, surgeon or dentist and performed by or under the supervision of the medical staff of the hospital or facility furnishing medical or dental services. It is further understood that the undersigned will assume full responsibility for any such action, including payment of costs. Occasionally, Program/Race activities may be photographed, videotaped, or audiotaped for educational, publicity or fundraising purposes. I hereby grant full permission to any and all of the foregoing to use my name and or likeness in any broadcast, telecast, video, or print media reporting or advertising without compensation (e.g., as part of marketing materials, social media or Program/Race websites). I, do hereby, for myself, my heirs, executors and administrators, release and forever discharge and hold harmless the Released Parties acting officially or otherwise, from any and all claims, demands, actions or causes of action which in any way arise from my participation in the above Program/Race.

You must be over 18 years of age OR the parent/legal guardian of a minor under 18 years of age OR the legal guardian of an incapacitated and/or mentally challenged person in order to agree to the waiver below.
